Terms and Conditions (T&C) for the Trading Mentoring Program

 

1. Scope

1.1 These Terms and Conditions (T&C) apply to all contracts concluded between [Your Name or Company Name] (hereinafter referred to as "Provider") and the customer (hereinafter referred to as "Participant") regarding participation in a trading mentoring program.

1.2 Deviating terms of the Participant shall not be recognized unless the Provider expressly agrees to their validity in writing.

 

2. Subject of the Contract

2.1 The Provider offers individual trading mentoring services aimed at imparting knowledge and techniques in the field of trading to the Participant.

2.2 The exact scope and content of the mentoring program will be specified in the respective contract between the Provider and the Participant.

 

3. Conclusion of Contract

3.1 The presentation of mentoring services on the Provider's website is not a legally binding offer but an invitation for the Participant to submit an order.

3.2 By ordering a mentoring program, the Participant makes a binding offer to conclude a contract. The contract comes into effect when the Provider accepts the order by sending a confirmation email.

 

4. Scope of Services

4.1 The Provider provides the mentoring services agreed in the contract to the best of their knowledge and belief.

4.2 The services will be provided by the Provider personally or by third parties appointed by the Provider.

4.3 The Provider does not guarantee any specific results, especially no financial profits or positive trading outcomes for the Participant.

 

5. Confidentiality

5.1 The Participant agrees to treat all information, strategies, techniques, and materials received during the mentoring program as confidential and not disclose them to third parties.

5.2 This obligation remains in effect even after the mentoring program ends.

 

6. Use of Content

6.1 The content provided during the mentoring program is for the Participant’s personal use only.

6.2 Any sharing, duplication, publication, or commercial use of the content is prohibited without the Provider's express written consent.

 

7. Liability

7.1 The Provider is liable for intent and gross negligence. In cases of simple negligence, the Provider is only liable for breaches of essential contractual obligations (cardinal duties), and the liability is limited to the typical and foreseeable damage.

7.2 The Provider is not liable for any financial losses incurred by the Participant in connection with trading activities.

 

8. Prices and Payment Terms

8.1 The participation fees for the mentoring program are specified in the respective contract.

8.2 Payment is due in advance unless otherwise agreed.

8.3 The Participant is in default without further notice from the Provider if payment is not made within 14 days of the due date.

 

9. Cancellation and Withdrawal

9.1 The Participant may cancel the contract free of charge up to 5 days before the start of the mentoring program. After that, cancellation fees will apply.

9.2 The Provider reserves the right to cancel or reschedule the mentoring program for an important reason. In such cases, the Participant will be refunded the fees paid.

 

10. Data Protection

10.1 The Provider collects, processes, and uses the Participant's personal data only in accordance with the legal requirements and exclusively for the purposes of contract execution and Participant support.

10.2 Further information on data protection is provided in the Provider’s privacy policy.

 

11. Final Provisions

11.1 Changes and additions to this contract must be made in writing.

11.2 The law of the Federal Republic of Germany applies.

11.3 If any provisions of these T&C are or become ineffective or unenforceable after the conclusion of the contract, the effectiveness of the remaining provisions shall remain unaffected.

 

12. Jurisdiction

12.1 The place of jurisdiction for all disputes arising from or in connection with this contract shall be [Insert Location], provided the Participant is a merchant, a legal entity under public law, or a public law special fund.
